By signing the participant´s contract, booking an Event service via e-mail, invoice or the online booking tool(s) (in short: booking) as well as by purchasing a ticket or sign-up via guest list (in: short registering) on

the participant and attendee of the Event expressly agrees to be bound by this agreement (the "Agreement"). If you are completing the registration on behalf of another individual or company, you warrant and represent that you have made the attendee or participating company aware of this Agreement and that he or she or it has accepted its terms and conditions.

 

4. Terms of participation and attendance

 

Invitations to participate or attend the Event are directed at companies whose services and/or sales offerings are appropriate to SWISS FINTECH Fair, a B2B fintech trade fair.

 

5. Requirements for Participants
 

5.1. Admittance & Safety

 

5.1.1. COVID-19 hygiene and safety

All participants are obliged to fully comply with the COVID-19 and hygiene protective measures applicable on site. The host reserves the right to request an official and complete Covid19 vaccination record (e.g. the Swiss Covid19 Certificate incl. proof of identiy of the certificate holder) from all participants and exhibitors before entering the venue.

 

The Host is at liberty to turn away persons who oppose compliance. Persons with Covid symptoms are urgently requested not to participate in/attend the Event and will be denied entry. Compensation of any kind will not be granted in case of denied admittance.

 

5.1.2. Non-discrimination policy

The Hosts prohibits discrimination, harassment, and bullying against any person for any reason - for example, because of age, ancestry, color, disability or handicap, national origin, race, religion, gender, sexual or affectional orientation, gender identity, appearance, matriculation, political affiliation, marital status, or any other characteristic protected by law.

 

The Host is committed to providing a safe, productive, and welcoming environment to all participants & attendees, as well as the organizational teams and venue staff. The Host has no tolerance for discrimination, harassment, or bullying in any form. Participants, attendees and Event staff are expected to adhere to these principles and respect the rights of others.  

 

5.1.3. What to do if you witness or are subjected to unacceptable or unsafe behavior

Participants and attendees should report any behavior inconsistent with the above mentioned principles to onsite event staff. Event staff will be happy to assist, contact venue security or local law enforcement. 

 

5.2. Pictures and filming

By attending/participating in the Event you grant the Host and their staff, partners as well as present media representatives the right at the Event to record, film, photograph, or capture your likeness in any media and to distribute, broadcast, use, or otherwise disseminate, in perpetuity, such media without any further approval from or any payment to you.

 

5.3. Waiver of Liability 

In consideration of being allowed to register for, and participate in the event, you hereby warrant and represent that you are age 18 or above and freely waive, release from liability, assume all risks, and covenant not to sue the Host or its employees, board members, agents, or volunteers for any expense, loss, damage, personal injury, including loss of life, illness, including but not limited to COVID-19, disability, property damage, or property theft or actions of any kind that you may hereafter suffer or sustain before, during, or after the event, unless said expense, loss, damage, personal injury, including loss of life, illness, disability, property damage or property theft or actions of any kind is caused by the sole, gross negligence of IEEE. This Liability Waiver and Release is specifically binding upon your heirs and assigns and is knowingly given. 

 

5.4. Other

All costs associated with your attendance/participation in the Event (e.g. tech devices, travel and accommodation expenses) shall be borne solely by you, and the Host shall have no liability for such costs.

 

The Host, in its sole discretion, reserves the right to change any and all aspects of the Event, including but not limited to the Event name, themes, format, analogue/digital presence, content, program, speakers, moderators, venue and time.

 

It is solely your responsibility to comply with any government visa requirements and failure to do so does not constitute a basis for a refund.

 

The Host reserves the right to deny access to the Event to anyone for any reason.

 

Any referral programs of SWISS FINTECH Fair are offered to members of SWISS FINTECH Association on a voluntary basis. There is no entitlement to participation. The participation, like the conditions of referral programs, will be communicated by the association to all members and a participation in a referral program must be confirmed individually before a legal claim can exist. Excluded as targets of referral programs are all partners and sponsors who have already been involved with SWISS FINTECH Association, SWISS FINTECH or Swiss Finance Startups in any form since 2014.  

6. Fees


Applicable fees are due upon registration. If payment is insufficient or declined for any reason, the Host may refuse to admit you and shall have no resulting liability.

Fees may be subject to sales tax, value added tax, or other taxes and duties, which, if applicable, will be charged to you in addition to the fees.

Once you have registered, your fees will not be adjusted downward based on any sponsorship, discount or any other reason-

 

7. SWISS FINTECH Fair pricing categories

 

There are two price categories available at the SWISS FINTECH Fair and displayed on the above mentioned websites.

 

STANDARD PRICE: The official pricing category that is applicable in general. 

 

MEMBER PRICE: The only exception to the standard pricing is made for active (= with paid 2023 membership fee) members of SWISS FINTECH (www.swissfintech.org). Only active members of SWISS FINTECH are authorized to make a purchase entering the member discount code. If you register using a special rate that is not applicable to you, you hereby give the Host the right to charge your card for the difference upon notice that the Host does not agree with your selection of a special rate, or your purchase will be declined with a cancellation fee of 250 CHF. If active SWISS FINTECH members don't opt for the member discount, the Host will not be able to refund the purchase.

 

PAYMENT: Payment can be done via credit card directly online. Or you can request an invoice from contact(at)swissfintech.org via e-mail (not possible for tickets only). Booking is confirmed after receipt of payment.

ALL PRODUCTS: All products, services and tickets are strictly non-refundable and not transferable, regardless of the selected pricing category.

 

8. Limited discount options

 

The Host has the right to limit the availability of discounted member options. Discounted member options are offered on a "first come, first serve" basis. Once the discounted option is sold out, members of SWISS FINTECH can opt for the standard price.

The Host has furthermore the right to limit the availability of other discounted options or special discount codes. Discounted options or special discount codes are offered on a "first come, first serve" basis. Once the discounted option is sold out, one can opt for the standard option.

 

9. Guest registration 

 

Certain Guests will receive the option to free access to the Event via guest codes or personal invitations. With specific service offerings and their booking, a limited number of guest codes/invitations may be included as stated in the respective product descriptions.

 

The Host states explicitly that guest codes/invitations are no tickets. Invitations and guest codes do not guarantee admissions. Guest codes and invitations must be redeemed via the guest registration form. Tickets via guest codes and invitations are only available while stock lasts. First come, first serve applies.

 

Unredeemed guest codes/invitations will be voided automatically as soon as tickets are sold out.

 

10. Cancellation, Substitution and Lost Ticket Policy
 

All Fees are non-refundable. The Host does not refund fees. There will be no carry over of registrations or fees to subsequent events.

Paid registrations that later join as speakers are not entitled to a refund of attendee fees paid. Registered ticket holders cannot convert their passes to complimentary sponsor passes. Any badges/wristbands issued by the host cannot be changed, substituted or transferred to another person.

 

11. Terms and Space allocation for exhibitors (Booths or/and VIP lounges)

 

Exhibitors’ positions are allocated by the Host. Requests for specific positions will be taken into consideration to the extent possible. Any exhibitor who wishes a subsequent reduction in stand space remains fully liable for paying for the whole space allocated to them if unused space cannot be re-let.

The Host has the right to cancel a booking if the stated criteria on the website are not met by the participant. 

 

Exhibitors are explicitly not allowed to provide catering (food, beverages) at their booth. Merchandise can only be offered directly at the booth. Exhibitors are not allowed to distribute any material (give-aways, flyers, etc.) at any other area in the location besides their booth.

 

12. Terms and Slot allocation for speakers (Pitch slot, Speaking slot or any other stage time)

 

Speaking slots are allocated by the Host. Requests for specific slots will be taken into consideration to the extent possible. The Host retains the right to adjust the agenda and slot times at any time without prior coordination with the speakers. 

The Host has the right to cancel a booking if the criteria stated on the website are not met by the participant. 

13. Withdrawal from the participant’s contract

 

Any participant withdrawing from the participation following registration remains liable for 100% of the stated offering price.

If exhibition spaces and stands have not been occupied by the given deadline on the opening day, the Host may dispose of these at his own discretion. The exhibitor thereby loses any claim to such booth space. The exhibitor remains fully liable for the totality of the rental for the booth space, the incidental costs and the services booked, as well as for all other costs that arise in connection with the non-occupation of the stand space or stand.

 

14. Booth construction

 

The booth will all be set up by the Host to ensure the greatest possible coordination. There is a fixed setup for all booths with no space for storage or additional furniture.

 

15. Set-up and dismantling times

 

The Host publishes schedules for setting up and dismantling stands and these must be adhered to in the interest of all exhibitors. It is not permitted to start dismantling stands prior to the formal end of the fair. Fines will be imposed on any exhibitor who builds up early without permission, who dismantles booths early, who abandons their booth or leave them prematurely as well as to exhibitors who dismantle their stands too late.

 

16. Insurance

 

It is a mandatory requirement for exhibitors to have insurance cover against fire, explosion and natural disasters for all exhibition items as well as liability insurance. By booking a booth, the participant/exhibitor confirms that they are fully covered according to the stated mandatory requirement without any additional check needed/provided by the Host.

 

17. Disclaimer of Warranties, Limitation of Liability
 

The Host gives no warranties in respect of any aspect of the Event or any materials related thereto or offered at the Event and, to the fullest extent possible under the laws governing this Agreement, disclaims all implied warranties, including but not limited to warranties of fitness for a particular purpose, accuracy, timeliness, and merchantability. The Event is provided on an "as-is" basis. The Host does not accept any responsibility or liability for reliance by you or any person on any aspect of the Event or any information provided at the Event.

Except as required by law, the Host shall not be liable for any direct, indirect, special, incidental, or consequential costs, damages or losses arising directly or indirectly from the Event or other aspect related thereto or in connection with this Agreement.

The maximum aggregate liability of the Host for any claim in any way connected with, or arising from, the Event or this Agreement, whether in contract, tort, or otherwise (including any negligent act or omission), shall be limited to the amount paid by you to the Host under this Agreement.

 

The Host accepts no duty to take care of exhibited materials and stand installations and declines all liability whatsoever. It is the participant’s duty to ensure that any device on display is suitably protected with equipment satisfying the accident-protection regulations. The participant will be held liable for any damage caused by exhibition materials, including in particular, during set-up and dismantling.

 

18. Location/Venue

 

In accordance with the regulations laid down by the municipal fire department, it is not permitted at any exhibition to use decorative material that may constitute a fire hazard. In no circumstances it is permitted for stairs and doors to be blocked and the corridors for the general public must be wide enough to cope with the expected number of visitors.

Extreme care must be exercised in setting up the fair. It is strictly prohibited to fasten exhibition objects or advertising materials to any of the ceilings or walls using nails, pins, drawing pins, needles or adhesives. All exhibition structures in the show rooms must be designed to be self-supporting and must be set up on an underlay to protect the floor. The load on the floor may not exceed 500 kg/m2 at any point. Fixed seats, mirrors, lights may not be moved.

 

19. Excerpt from the municipal noise ordinance

 

Article 1: For the purpose of the ordinance, noise is defined as acoustic effects which impair the health, performance or wellbeing of people.

Article 3 c.: It is prohibited to carry out any form of work that causes noise between 12 noon and 2 p.m. and from 7 p.m. to 7 a.m.

Article 25/1: Anyone who violates the provisions of this ordinance, who removes noise protection measures or impairs their performance, will be punished in accordance with article 37 of Zurich’s general municipal police regulations (Allgemeine Polizeiverordnung der Stadt Zürich).

 

20. Compilation of the fire protection guidelines for fairs and events

 

General information: From decorations no additional fire hazard may result. In the case of fire persons may not be endangered and escape routes not be impaired.

Material: Decorations in areas with public traffic must be of heavy inflammable material. Fire index 5.1/Classification SN EN 13501-1: (A2-s2, d0 – A2-s3, d0 – B-s2, d0 – B-s3, d0 – C-s2, d0 – C-s3, d0).

In case of fire materials may neither drip off burning nor develop poisonous gases. No inflammable decorations may be attached in escape routes. Play and advertisement balloons may be filled only with not inflammable gas or gas mixture.

Addition to material: Decorations from massif wood (e.g. boards) are also permitted, where difficult inflammable material with fire index 5.1 is required.

 

21. Privacy Policy
The Host is committed to protecting the privacy of its attendees and participants. Its Privacy Policy is available at https://www.swissfintechfair.com/privacy

 

22. Intellectual Property
 

All intellectual property rights in and to the Event, the Event content, and all materials distributed at or in connection with the Event are owned by the Host or the Event sponsors or speakers at the Event. You may not use or reproduce or allow anyone to use or reproduce any trademarks (including without limitation "SWISS FINTECH") or other trade names appearing at the Event, in any Event content or in any materials distributed at or in connection with the Event for any reason without the prior written permission of the Host.

For the avoidance of doubt, nothing in this Agreement shall be deemed to vest in you any legal or beneficial right in or to any trademarks or other intellectual property rights owned or used under license by the Host; nor does this Agreement grant to you any right or license to any other intellectual property rights of the Host, all of which shall at all times remain the exclusive property of the Host.

 

23. Force Majeure

The Host retains the right to reschedule, shorten, lengthen or cancel the SWISS FINTECH Fair should there be compelling reasons for doing so - including but not limited to the Covid19 pandemic situation at the time - or in the event of force majeure. In such cases, the participant has no right to withdraw, nor any claim for compensation. The participant has no right to claim any compensation whatsoever if SWISS FINTECH Fair is not held on justified grounds. All verbal agreements, authorisations and special arrangements must be confirmed in writing, failing which they will not be recognised.

24. Miscellaneous

 

The Host´s failure to exercise any right shall not be deemed a waiver of any further rights. The Host shall not be liable for any failure to perform its obligations where such failure results from any cause beyond the Host’s reasonable control. If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary for this Agreement to otherwise remain in full force and effect and enforceable. This Agreement is not assignable, transferable or sub-licensable by you except with the Host’s prior written consent.

Both parties agree that this Agreement is the complete and exclusive statement of the mutual understanding of the parties and supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of this Agreement, and that all modifications must be in a writing signed by both parties, except as otherwise provided herein.

No agency, partnership, joint venture, or employment is created as a result of this Agreement and you acknowledge that you do not have any authority of any kind to bind the Host in any respect whatsoever.

 

25. Applicable law and place of jurisdiction

 

This agreement shall be governed by and construed in accordance with Swiss law. The parties elect the Host’s domicile as the place of jurisdiction.
